On the ruling by a federal appeals court that President Obama violated the Constitution when he bypassed the Senate to fill vacancies on the National Labor Relations Board…

This is not gonna sit well in the White House. So they'll take it up to the Supreme Court and we'll see what happens from that point on. I think what they'll say is, "What difference does it make? What difference does it make if the president wants to make appointments? What difference does it make whether it's constitutional or not? The Constitution's old-fashioned. Look at the Second Amendment. It was never supposed to be in there. The Constitution doesn't have anything in there, when it was written, about abortion. The Constitution permitted slavery. To hell with the Constitution. What does it matter?" That will be the reaction of many on the pro-Obama side. "What do you mean separation of powers? Why do we need separation of powers? We think Obama's power's absolute. Why do we need to separate Obama's power?" That would be the low-information voter reaction. "What difference does it make if the president has no limits in his power? The president's a good guy, cares about us, loves us, Santa Claus, why shouldn't he have all the power he wants?" This is what we're gonna be up against.

On recent CBO estimates that the cost of Obamacare has come down, owing to the Supreme Court’s ruling…

Just so you know, the “non-partisan” budget scorekeeper [at the] CBO is being headed at present by a woman, Melinda Beeuwkes Buntin, who has been the Deputy Assistant Director to CBO’s Health Services Department since the middle of 2011. She has donated more than $26,000 to Democrat candidates, $2,300 of that going to Obama in 2008. Before Obamacare was passed she was cited as an Obama spokeswoman. In 2009-2010 she visited the Obama White House eight times. She is the non-partisan budget scorekeeper at CBO. She’s an Obama hack.

On the Supreme Court Obamacare ruling…

A giant, total fraud was perpetrated on this country yesterday. The Supreme Court, as an institution, is forever tarnished. There are now no limits, anywhere, on the size, scope, the growth, of government. We were the victims of a purposeful, intentional fraud yesterday. There is no way – were anybody in Washington concerned about the constitution – there is no way Obamacare gets anywhere close to being law in this country. There is no way it even approaches constitutionality. And the Chief Justice of the U.S. Supreme Court knew that. Felt it was his duty, however, to “save” the legislation. I don’t even care about motivation. I don’t care if it’s ‘cause he wants the New York Times and Washington Post to love him. I don’t care if it’s ‘cause he wants to be the next John Marshall. I don’t care. All I know is that we were defrauded in front of our eyes.

On the Supreme Court’s impending decision on the constitutionality of Obamacare…

Many people I know, and many people I don’t know, are now predicting what the Supreme Court is going to do on Obamacare tomorrow. And I haven’t kept a running tally of all the predictions from people I know and people I don’t know, in the media and outside the media. But it sure seems like most people think, that at a minimum, the mandate’s gone. By 5-4. With Roberts writing the majority opinion and Ginsburg writing the dissent.

On the 5-4 decision of the Supreme Court, led by Chief Justice John Roberts, that Obamacare is constitutional…

What we now have is the biggest tax increase in the history of the world. What we have been told by the Chief Justice of the Supreme Court and four liberals on the court – Obamacare’s just a massive tax increase. That’s all it is. Obama lied to us about that. He lied to Democrats – lied, it wasn’t a tax, there was no way it was a tax. The Chief Justice was hell-bound, hell-bent to find a way to make this law applicable, so he just decided, “You know what? As a tax increase it works, because there’s no limit on the federal government’s ability to tax. It’s right there in the preamble to the constitution: right there in Article 1, Section 8, General Welfare Clause. It’s been established. Congress can tax whatever, whoever, whenever, how much they want.” … Even when they don’t ask for it, the Supreme Court is gonna find a way to make what they want to do legal, ‘cause John Roberts said, “It’s not our job here to forbid this. It’s not our job to protect people from outcomes. It’s not our job to determine what it is, right or wrong, or any of that, we just get to look at it and we can’t forbid this, this is what the elected representatives of the people want.” Now the elected representatives of the people were deceived.

On predictions by some liberal pundits that a Supreme Court ruling against Obamacare will help Obama in November…

We’ve got an economy that’s in a shambles, there aren’t any new jobs… there’s nothing, there’s not one element of Obama’s record on which he can run for reelection. There’s not one thing they can tout, that has been good for America, and thus Obama deserves four more years. Not one thing! So. The Supreme Court throws out the mandate. Let’s say. And let’s say they throw out some other parts of the law. What are they saying in Realville, where real people live? The Supreme Court has just said “Obamacare is illegal.” That’s what “unconstitutional” means – it’s illegal. They want to try and spin that as a positive? Let ‘em try. Let them try spinning, Obama’s signature legislation – the thing his name’s on. Obamacare! The great savior of this country. And the Supreme Court says it’s illegal.

[Rebroadcast material]… On why President Obama would ask the Supreme Court for an expedited ruling on Obamacare…

We’ve mentioned a couple possibilities as to why the regime has asked for a quick review and decision from the Supreme Court on Obamacare. And I want to throw out another possibility. Given where Obama is in the polls – and folks, it is much worse than the state-controlled media polls indicate – I think it’s disastrous. Simple logic would tell us, it’s disastrous. We are on the verge of a depression. The idea that the incumbent President has a chance to be reelected is absurd, in those circumstances. Yet the media narrative each day is of course just the opposite because Obama’s their guy… So they ask for a quick review of Obamacare. One of two ways to look at it. They’re either very confident they’re going to win this thing, or – or – given who Obama is, a community organizer who loves agitating people, and who is probably very connected, if not personally, his regime, to these Wall Street protests, and he’s … egging them on, and so is Biden. They’re egging these people on. So there’s a part of me that says Obama would love the court declaring Obamacare unconstitutional. I think Obama loves playing a victim. I think he would love to take that to the bank and say, “See what they’re doing to your free healthcare?”

On the Supreme Court’s announcement that it will take up Obamacare for deliberation in March of 2012…

The regime is out there saying they want an early decision. The regime is suggesting they would like a decision on the constitutionality of Obamacare next June. That’s gonna have a possibility, the potential of making health care the issue during the campaign. And I don’t know how that works out for the regime, folks. If you look at what just happened in Ohio, where Issue 3, 66% of the American people want no part of the mandate requiring them to buy insurance, the news about health care every day, it gets worse, in terms of people losing their insurance, costs going up. But the regime claims that they want this decision before the election. And they’re out there predicting victory.
